Terms and conditions

The following provisions establish the general conditions of sale which govern the contractual relationship between the seller CREOBIO (hereinafter “CREOBIO”) and the customer (hereinafter “Customer or Consumer”) having as its object the distance selling, in Italy, of the products offered, via the e-commerce website creobio.com (hereinafter “the Site”).

The seller is the company CREOBIO, with registered office in via Pasteur (PIP area), Gravina in Puglia (BA) -70024, telephone number 080 3255843 The general conditions of sale that apply to the contractual relationship between CREOBIO and the Customer are those published on the Site at the time the order is placed.

The order implies acceptance of these general conditions of sale.
The Parties agree that the contract is governed by Italian law.

The sales process through the Site was carried out in full compliance with the regulations on distance selling and e-commerce, and in particular in compliance with the Italian Consumer Code Legislative Decree no. 206 of 6 September 2005 and subsequent amendments and additions.

The use of the distance selling process described in these general conditions of sale is reserved for consumers (hereinafter "the Customer" or "the Consumers") who act on their own behalf and are resident in Italy.

Order confirmation and archiving:

Confirmation and storage of the order The order form will be stored in the database of CREOBIO for the time necessary to execute it and, in any case, within the terms of the law.

Dispute resolution :

In the event of a dispute arising from this contractual relationship, the parties undertake to seek, before any legal action, a solution dictated by common sense.
The parties agree that all disputes relating to sales through the website as described above will be referred to the jurisdiction of the court of BARI (Justice of the Peace of Gravina in Puglia, or, in the event of dismissal, the substitute authority, the Court of Bari, or the Court of Appeal of Bari).
The applicable law is Italian law. For anything not specified, reference is made to the consumer regulations in force at the time of the order. WE RECOMMEND SENDING A COPY OF THE GENERAL TERMS AND CONDITIONS AND REQUESTING THEM TO BE RETURNED, SIGNING EACH PARAGRAPH TO ACKNOWLEDGE, ACCEPTANCE, AND SIGNATURE, OR SIGNING AT THE END, but including a reference to the unfair terms (indicate all paragraphs, appropriately numbered, and summarizing their content: e.g., order, withdrawal, etc.).

The order confirmation will include the terms, conditions, and procedures for the right of withdrawal, completed with the withdrawal form. To access your order form, the Customer must go to "Your Account" and "Order Status."

A summary of the instructions for accessing the order form will be included in each order confirmation email.
In case of invoice request, the Customer must request it at the same time as the order, by sending an email to the address:

Retailers, wholesalers, or anyone who intends to purchase products available on the Site for subsequent resale may not make purchases on the Site. Orders placed through the Site imply knowledge and acceptance of these general terms and conditions of sale.
The products covered by the contractual relationship governed by these general conditions are all the items published on the Site at the time the order is placed, as specified in the "Products" section.

In the case of promotional offers having a certain duration, the Consumer must pay attention to the time limits of validity of the offer.

Acceptance of the offer :

Acceptance and confirmation of the order are carried out by entering data in the following phases:
1. Adding the selected products to the cart
2. Cart validation
3. Indication of personal coordinates
4. Select payment method

Up to the "payment" stage, you can modify your order by clicking the "cart" icon in the top right of the screen. If paying by credit card, the customer's final acceptance is confirmed by entering their bank details (credit card number and expiration date). If paying via PayPal, the customer's final acceptance is confirmed by entering the required information on the PayPal website. If paying by bank transfer, the customer's final acceptance is confirmed by making the payment and subsequently crediting the agreed-upon amount to the account indicated at the time of order confirmation.

1. Rates
The price of products online on the Site, indicated in euros, is the price in effect at the time the Customer places the order. Prices include the VAT rate in effect at the time of the order. The product prices applicable to the contractual relationship with the Customer will be those in effect and published on the Site at the time the Customer places the order.

2. Product features
In accordance with Articles 52 and 53 of the Consumer Code, Fattibene provides Consumers with information about its Products and, on the Website, informs Consumers of all the main characteristics of the Products offered (size, composition, description, etc.) and the price, including taxes and duties. Product characteristics will be visible through a digital or photocopy published on the Website, illustrating the offer as faithfully as possible. The image is not part of the contractual relationship between the parties. The artisanal (hand-crafted) nature of the product makes it unique and exclusive; furthermore, changes may occur due to the reproduction of the image, therefore the Consumer acknowledges that the photograph of the Product on the Website is indicative only. All information is provided via the Website in accordance with Article 52 of the Consumer Code.

The order :

An order placed by the Customer implies acceptance of all the provisions of these general conditions of sale (choose the method: electronically by checking the appropriate boxes or by resend the duly signed general conditions by fax or email, as suggested at the end of this document). Any order placed by the customer via online payment will be processed by CREOBIO only after the payment has been accepted.

CREOBIO will send the Customer an order confirmation email containing all the order details and the information required by law: a summary of the General Conditions of Sale, pre-contractual information relating to the essential characteristics of the purchased goods, a detailed indication of the price, the payment method used, the chosen payment instrument, delivery costs, delivery terms, as well as information and instructions on the right of withdrawal and related costs, and legal guarantees.

The sale will be considered final once this confirmation, product availability, and payment have been sent to the customer. The contractual reference date, for warranty, withdrawal, etc. purposes, will be the date of the order confirmation and acceptance. To modify the order, the customer can click on the "Your Cart" icon at the top right of the screen.

Changes are always possible up to the stage before payment. The Customer may cancel the order using their right of withdrawal according to the procedures set out in the Withdrawal section. The request to cancel the order can be processed by sending an email to info@creobio.com (preferably by certified mail, or by sending a registered letter with acknowledgement of receipt to the registered office indicated above). Once confirmed, the order CANNOT BE CHANGED ONLINE, neither with respect to the items nor the delivery address, without prejudice to the Customer's right of withdrawal.

Orders that are returned to the sender after multiple delivery attempts by the courier cannot be returned. If the order has been paid for, it will be refunded minus a penalty equal to the shipping costs (minimum €50.00) and the cost of used and unsold materials, calculated as a flat rate of 20% of the order amount. If the customer wishes to change the delivery date, they must contact the courier directly upon delivery. The customer must retain the information contained in the order confirmation sent by CREOBIO on paper or electronically.

CREOBIO sells the products on its website only to retail and end consumers. Any order that manifestly does not correspond to a retail sale and, more generally, any fraudulent or presumed fraudulent order will be considered null and void by CREOBIO and prosecuted through the appropriate legal channels.
